Terms & Conditions

This terms and conditions were carefully designed to international applicable purchase terms for All Terrain Vehicles (ATV), Utility Vehicles (UTV), Scooters, Buggies and Motorbikes. The Terms and Conditions apply to all purchases at our Online Shop (www.mcbelize.com) or at our Showroom (Constitution Drive 1, Belopman, Belize) or from any other authorized dealer or reseller. 

By purchasing from us you accept these Terms & Conditions which apply to all purchases from Emerald Creations Ltd, Mouflon Carts or Mouflon Carts Belize. If you don't accept these Terms & Conditions, please don't buy from us. Thank you for your understanding. 

1. All displayed prices on this website are Belize Dollars.  
2. Fully assembled vehicles must be picked up from one of our dealers or at our showroom in Belmopan, Belize. Delivery can be arranged at an extra cost.
3. Minor cosmetic damage due to shipping (i.e. small cosmetic scratches on plastic) are not covered under warranty and is not grounds for a return. If you option to purchase a special priced “inna-di-box” product, please remember that these vehicles come 80-90% assembled and some assembly is required incl. basic mechanical skills.
4. Prices on our website may not reflect tax, title, or assembly fees and are subject to change without prior notification.
5. Buyer accepts full liability for the vehicle, damages, and any third party liability incurred from the vehicle use from date of sale.
6. The Buyer acknowledges that all sales are final and that there are no refunds, returns, or exchanges. In the unusual case of an agreed return a re-stocking fee of at least 30% is applied and automatically deducted from the refund. 
7. Buyer acknowledges that the warranty is with the manufacturer of the vehicle, not Mouflon Carts Belize. Mouflon Carts Belize is not liable for manufacturer’s products, warranty decisions, or any warranty associated with the purchased vehicle.
8. Buyer acknowledges that the warranty is for manufacturer approved warranty part replacement only.
9. The Buyer acknowledges that Mouflon Carts Belize does not make any warranty decisions. Warranty decisions are made by the manufacturer only and Mouflon Carts Belize is not liable for manufacturer’s warranty decisions, purchased vehicle or any part associated with manufacturer vehicle and/or warranty.
10. The Buyer acknowledges that the manufacturer warranty is maximum 6 months for engine and 3 months for drive train unless otherwise specified by Manufacturers website and /or contract.
11. All repairs, servicing or similar are commenced at our headquarters / Showroom in Belmopan. C.A. Mouflon Carts Belize doesn’t offer free pick up or delivery service.
12. The Buyer acknowledges that Mouflon Carts Belize does not offer a traveling mechanic service.
13. Manufacturer warranty does not include plastics, paint, body parts, accessories, chains, wheels, tires, batteries, bearings, ball joints, or any other wearable part.
14. Manufacturer warranty does not cover damage from misuse, abuse, or neglect.
15. Manufacturer warranty does not include shipping costs associated with warranty parts to and from the manufacturer and buyer will be responsible for these costs.
16. Servicing and parts exchange is strictly at our main location / showroom in Belmopan / Belize / C.A. The Buyer acknowledges that he is responsible for transportation to and from this location for servicing or spare part supply.
17. I, as buyer, acknowledge and agree to be above and that I am 18+ years of age.
18. I, as buyer, acknowledge and agree to follow the manufacturer's minimum age recommendation Warning Label on the ATV and agree that I am not purchasing the vehicle for anyone under the age recommendation on the vehicle warning label.
19. I, as a buyer acknowledge and agree to be liable and pay for all court costs and attorney fees associated with any proceedings that may involve buyer, vehicle purchased, and Mouflon Carts Belize. By this Agreement, it is my intention as buyer, to surrender and waive any rights to sue or exercise any legal rights to seek damages from Mouflon Carts Belize & Emerald Creations Ltd. and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf. This Agreement shall be affecting and binding upon my heirs, agents, personal representatives and assigns.
20. I, as buyer, have carefully read the foregoing and acknowledge that I understand and agree to all the above Terms and Conditions. I have had the opportunity to ask any and all questions regarding this Agreement and the effect of the same.
21. I, as buyer, am aware that by purchasing this item and sending/remitting payment for it/them, I assume all risk, and waive and release certain substantial rights that I may have or possess.
22. I, as buyer, hereby certify that I have been informed of The ATV/UTV Rider Course that is available online at atvsafety.org.
23. I, as buyer, agree Mouflon Carts Belize is not Liable for function and/or reliability of vehicle purchased, manufacturer's warranty decisions, vehicle itself, or any part associated with manufacturer vehicle and/or warranty.
24. I, as buyer, agree to read the user's manual and all other associated documentation carefully before operating my vehicle.
25. I, as buyer, agree to inspect my vehicle to be sure all nuts, bolts and chain are tight and the vehicle is safe for operations. I assure to repeat this procedure at least once a month.
26. I, as buyer, agree to wear a helmet and protective gear when riding.
27. I, as buyer, acknowledge that it is my responsibility, to ascertain and obey all laws in regards to the possession and use of any items purchased from Mouflon Carts Belize.
28. Mouflon Carts Belize will not be liable for the misuse of any products purchased from Mouflon Carts Belize or any of its distributors or agents.
29. I, as buyer, have read this waiver of liability, assumption of risk and indemnity agreement, fully understand its terms, and understand that I, as buyer, am giving up substantial rights by agreeing to this waiver and have brought it freely and voluntarily without any inducement, assurance or guarantee being made to me. My purchase is to be considered as a complete an unconditional release of all liability to the greatest extent allowed by law.
30. I understand that buying from Mouflon Carts Belize and/or on our website that any vehicle sale is final and there are NO returns, NO Refunds, NO Exchanges and that I have read and will comply with the entire above listed Terms & Conditions.
31. I, as buyer, acknowledge and understand that riding an all-terrain-vehicle, Utility Vehicle, dirt bike, go kart, motorcycle, moped, pocket bike and gas scooter is a dangerous activity that requires strenuous exercise and various degrees of skill and experience for individual riders (please visit atvsafety.org if you need further training).
32. I, as buyer, understand that these activities can result in serious injury to the person and damages to property and voluntarily assume any and all risk associated with loss, damage or injury while riding the vehicles advertised on in our shop, at our dealers or our website.
33. I, as buyer, am aware of the risks, hazards and dangers of personal injury, death and disability inherent with the specific use of these vehicles as well as the inherent risks, hazards and dangers of personal injury and disability increase with inexperienced riders.
34. I, as buyer, agree to release and forever discharge Mouflon Carts Belize and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf and the manufacture from any and all claims, actions, damages, liabilities, cost or expenses and attorney fees which are related to, arise out of, or are in any way connected to your participation or use of these vehicles, use of equipment or property supplied by Mouflon Carts Belize or your presence upon the premises, whether or not such claims, actions, damages, liability, cost or expenses are caused by the negligence of the seller, manufacture or distributor.
35. I as a buyer agree that technical details of purchased items might differ to the written information on flyers, website or other informational outlets, due to technological and mechanical improvements.
